Terms of Service

1. About these terms

These terms apply when you use this website and when you engage Digital Adverza for marketing or software services. By using the site you accept them.

Registered business: Digital Adverza Marketing Agency (SMC-Private) Limited, Haider Arcade, 2nd Floor, Office 04, Northern Bypass Chowk, Bosan Road, Multan, Pakistan
Incorporated in Pakistan under the Companies Act, 2017. Corporate Unique Identification No. 0338791 (SECP). Verify with the SECP.

If we sign a separate written agreement or statement of work with you, that document takes precedence wherever it conflicts with these terms.

2. Using this website

You may browse the site, and use its content for your own reference. You may not:

  • copy our text, designs, case studies or images for commercial use without our permission;
  • attempt to gain unauthorised access to the site or its underlying systems;
  • use the site to send unlawful, misleading or abusive content;
  • scrape the site at a scale that disrupts it for other visitors.

We aim to keep the site available and accurate, but we don't guarantee uninterrupted access, and we may change or remove content at any time.

3. Quotes and prices

Prices shown on this website are indicative starting prices, not offers. They are shown in your local currency based on your approximate location, and you can change the currency yourself at any time using the switcher.

Currency prices are set independently for each market, they are not live exchange-rate conversions of one another, and they may differ from what a straight conversion would suggest.

Your final price is whatever we confirm in writing after understanding your requirements. Taxes are shown or noted separately where they apply, and are your responsibility unless we state otherwise in writing.

4. Engaging us

A contract begins when we confirm your project or retainer in writing and you accept it, not when you submit an enquiry form or send a message. Enquiring costs you nothing and commits you to nothing.

Monthly retainers run month to month. We don't ask for long-term lock-in contracts.

5. What we need from you

To deliver good work we rely on you to:

  • give us the access we need, ad accounts, page admin rights, hosting, brand assets;
  • provide content, approvals and feedback within a reasonable time;
  • make sure anything you give us is accurate and that you have the right to use it;
  • fund your own advertising spend directly, unless we've agreed otherwise in writing.

Where a delay on your side pushes back a deadline, timelines shift accordingly. We'll always tell you when that happens rather than let it drift silently.

6. Payment

  • Retainers are invoiced monthly in advance unless agreed otherwise.
  • Project work is typically invoiced part in advance and the balance on delivery, as set out in your quote.
  • Advertising budget is separate from our management fee, and is paid by you to the platform.
  • If an invoice is significantly overdue we may pause work, after telling you first.

7. Ownership of work

Once you have paid for it in full, the finished work is yours, designs, copy, creatives, and websites we build for you.

We keep ownership of our own underlying tools, templates, frameworks and internal processes, and of our software products (such as our ERP and IMS systems), which are licensed to you rather than sold.

Unless you ask us not to, we may show work we've done for you in our portfolio and marketing. Tell us at any time and we'll take it down.

8. Results and third-party platforms

Case studies and figures on this website describe results achieved for specific clients in specific conditions. They are real, but they are not a promise of what your business will achieve, results depend on your market, budget, product and competition.

Much of our work runs on platforms we don't control, including Meta, Google, TikTok and YouTube. Their rules, pricing and algorithms change without notice, and they can restrict or suspend accounts under their own policies. We'll work to resolve issues, but we aren't responsible for their decisions.

9. Cancellation

Either of us may end a monthly retainer by giving 30 days' written notice. You pay for work completed up to the end of the notice period; we hand over your assets and access.

For project work, if you cancel partway we'll invoice for the work done to that point.

If you are a consumer in the UK or EU buying online, you may have a statutory right to cancel within 14 days. Nothing here removes rights the law gives you.

10. Liability

We don't limit our liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit.

Subject to that, our total liability for any claim connected to our services is limited to the fees you paid us in the three months before the claim arose, and we are not liable for indirect or consequential loss, including lost profits or lost data.

11. Governing law

These terms are governed by the laws of Pakistan, and disputes are subject to the courts of that jurisdiction.

If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country where you live.
